1. Acceptance of Terms

By creating an account, accessing, or using Dojo Partner (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Dojo Partner is a business management platform operated by Dynamite Advertising (“we,” “us,” “our”) for academy operators (“Operators”) and, through them, their staff and members. The Service provides a range of tools to help Operators manage and grow their business, which may include tools made available to their staff and members. The specific tools, features, and functionality available on any account may vary and may change, expand, or be modified at any time at our discretion. These Terms govern access to and use of the Service regardless of which specific tools or features are enabled on your account.

3. Accounts

3.1 Operator accounts. To use the Service you must create an account and provide accurate, current information. You are responsible for safeguarding your account credentials and for all activity under your account.

3.2 Member and staff access. Members and staff may access certain parts of the Service through accounts provisioned by their Operator, using access credentials issued by the Service. Operators are responsible for the accuracy of the contact information they provide for their members and staff.

3.3 Eligibility. You must be at least 18 years old to create an Operator account. The Service is not directed to children; where an Operator enrolls minors as members, additional terms in our Privacy Policy apply.

4. Subscription, Billing & Cancellation

4.1 Plans. The Service is offered on one or more subscription plans, with the features, limits, and pricing described at checkout or in your account settings. Available plans and their terms may change from time to time. Fees are billed in advance on a recurring basis through a third-party payment processor.

4.2 Changes & cancellation. You may change or cancel your subscription at any time from your account's billing settings. Cancellation takes effect at the end of your current billing period; you retain access through that period's end. We do not provide partial refunds for unused time within a billing period, except where required by law.

4.3 Non-payment. We may suspend or terminate access to the Service for accounts with failed or overdue payment, after reasonable notice.

5. Acceptable Use

You agree not to: use the Service to violate any law; upload or enter content you do not have the right to use; attempt to gain unauthorized access to any part of the Service or another account; probe, reverse-engineer, or attempt to derive the source code, underlying methods, or architecture of the Service; interfere with or disrupt the Service's operation; or use the Service to send unsolicited communications in violation of applicable law (e.g., CAN-SPAM, TCPA).

6. Staff Data and Employer Responsibilities

Staff Data. Where an Operator manages staff within the Service, certain operational and performance-related information about those staff members may be collected and stored as part of the Service.

Operator Obligations. Operators must inform their staff members that:

• Their activity within the Service may be recorded
• Certain information about their performance may be visible to administrators
• Certain records may be retained by the Service for administrative and continuity purposes

Operators are responsible for complying with all applicable employment, privacy, and data protection laws in their jurisdiction regarding employee monitoring and data collection. Dojo Partner provides the platform; the Operator bears responsibility for its lawful use with respect to employment relationships.

7. Automated Features

Automated and Assisted Tools. The Service may include tools that use automated or AI-assisted technology to support certain functions. The specific tools available, how they are configured, and how they behave may vary by account and may change over time without notice.

Built-In Limitations. Certain automated features are subject to built-in limitations that cannot be disabled or overridden through account configuration, including limitations on providing medical, clinical, therapeutic, legal, or other professional advice. Automated features are not a substitute for advice from a qualified professional.

Operator Configuration Responsibilities. Operators who configure any automated or content-related feature are responsible for ensuring the content they provide does not contain medical claims or clinical diagnoses, legal advice regarding employment or other matters, content that violates applicable law, or content that is inappropriate for the age range of their users.

8. Account Access and Roles

Access. Different areas and functions of the Service may be made available to different types of users on an account (for example, Operators, staff, and members), each accessed using credentials issued by the Service. Users are responsible for keeping their contact information current and for maintaining the security of their access.

Role-Based Access. Where role-based access applies within an account, a user may be limited to viewing or managing only the information relevant to their assigned role. Operators are responsible for assigning appropriate roles and access levels within their account.

9. Data Controller Relationship

Business Data. For data about the individuals an Operator manages within the Service — including their own staff, leads, and members — the Operator acts as the data controller and Dojo Partner acts as the data processor. The Operator's configuration determines what data is collected and how it is used within the Service. Operators who use the Service to process data about individuals in the European Economic Area or United Kingdom should ensure their use complies with GDPR and UK GDPR requirements, including entering a Data Processing Agreement with Dojo Partner if required. 10. Intellectual Property

The Service, including its software, design, and branding, is owned by Dynamite Advertising and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes during your subscription. You retain all rights to the data you, your members, and your staff enter into the Service (“Your Data”). You grant us a limited license to host, process, and display Your Data solely to provide the Service.

11. Third-Party Services

The Service relies on various third-party providers to deliver certain features. Your use of the Service is also subject to those providers' own terms where applicable. We are not responsible for the acts or omissions of third-party providers.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that content produced by any automated feature will always be accurate.

13. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

14. Termination

We may suspend or terminate your access to the Service for violation of these Terms, non-payment, or if required by law. You may stop using the Service and cancel your subscription at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date and, for material changes, notify Operators by email or in-app notification at least 14 days before the change takes effect. Continued use of the Service after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws applicable in our jurisdiction of operation, without regard to conflict-of-law principles, except where superseded by mandatory local law (e.g., GDPR/UK GDPR for EEA/UK users, as described in the Data Controller Relationship section above).
